1. Who we are and what these terms cover

These Terms of Service ("Terms") govern your access to and use of TreulogyAI (treulogy.com), including the website, the application, and all services offered through them ("the Service").

TreulogyAI is a brand of Common Sense Goods Inc., a corporation incorporated in Alberta, Canada ("we," "us," or "our").

By purchasing access to or using the Service, you agree to these Terms. If you do not agree, do not purchase or use the Service.

2. What TreulogyAI is

TreulogyAI is an AI-assisted eulogy writing application. It guides you through a series of questions about a deceased loved one and uses your responses to generate a personalized eulogy using artificial intelligence.

2.1 — What the Service is

  • A practical writing tool designed to help bereaved individuals create a meaningful starting point for a eulogy
  • An AI-powered application — the eulogy is written by artificial intelligence, not by a human writer

2.2 — What the Service is not

  • A professional writing service — no human writer reviews, edits, or approves your eulogy
  • A grief counselling, therapy, or mental health service
  • A guarantee of any particular quality, outcome, or reception of the eulogy
  • A substitute for your own review, personalization, and judgment before delivering the eulogy

2.3 — AI-generated content disclosure

**You acknowledge that all eulogy content generated by TreulogyAI is produced by artificial intelligence.Your responses are not read by our team for content, marketing, or editorial purposes. Access to user data is limited to essential operational purposes only — such as responding to deletion requests, resolving technical issues, or complying with legal obligations — and is subject to strict confidentiality obligations.

We strongly encourage you to read the generated eulogy carefully, personalize it with your own voice and any details you feel are missing, and make it your own before delivering it. The AI-generated output is a starting point, not a finished product.


3. Account creation and access

3.1 — How access works

Access to TreulogyAI is provided following purchase on treulogy.com. Upon completing your purchase, a secure, time-limited, single-use login link will be sent to the email address you provided at checkout. This link provides access to your TreulogyAI account.

3.2 — Your account

You are responsible for:

  • Providing an accurate email address at checkout
  • Keeping your login link and account access secure
  • All activity that occurs through your account
  • Notifying us immediately at legal@treulogy.com if you believe your account has been compromised

You may not share, sell, or transfer your account or login access to any other person.

3.3 — One account per purchase

Each purchase entitles one individual to access the Service. Accounts are personal and non-transferable. If you are a funeral home or other business purchasing access on behalf of multiple users, contact us at legal@treulogy.com to discuss our B2B licensing options.

Business customers purchasing B2B licenses are subject to separate B2B Terms of Service and a Data Processing Agreement. If you are a funeral home or professional user, contact legal@treulogy.com for applicable terms before using the Service.


4. What your purchase entitles you to

4.1 — Eulogy generation (fair use)

A single purchase of TreulogyAI entitles you to:

  • Generation of up to 100 eulogies for your own personal use
  • Access to the full guided question experience for each eulogy
  • The ability to generate eulogies for multiple individuals using your single account

We set this limit generously — it is far beyond what any individual would need for personal use. It exists solely to protect the Service from abuse and ensure a quality experience for all users. If you have a legitimate need that approaches this limit, contact us at legal@treulogy.com and we will work with you.

We also reserve the right to apply reasonable rate limits on generation frequency to maintain service quality and prevent abuse.

4.2 — Personal use only

Your purchase entitles you to use the Service for personal, non-commercial purposes only. This means you may use TreulogyAI to write eulogies for people in your own life — family, friends, and loved ones.

You may not use TreulogyAI to:

  • Write eulogies commercially on behalf of others for payment
  • Resell, sublicense, or provide access to the Service to third parties
  • Use the Service as part of a business offering without a separate B2B license agreement

Funeral homes, celebrants, and other professional users must contact us at legal@treulogy.com for B2B licensing terms before using the Service commercially. Use of a consumer account for commercial purposes pending B2B licensing constitutes a material breach of these Terms.

4.3 — Service availability

We make reasonable efforts to keep the Service available at all times. However we do not guarantee uninterrupted availability. The Service depends on third-party infrastructure including Bubble.io and OpenAI, and may be subject to outages, maintenance, or interruptions outside our control. We are not liable for any loss or inconvenience caused by service unavailability.

4.4 — Business customers — interim terms

TreulogyAI offers subscription-based B2B licensing for funeral homes and professional users. B2B customers are subject to separate terms covering subscription billing, seat licensing, white-label use, data processing obligations, and end user consent responsibilities.

Until formal B2B Terms of Service are in place, any business use of the Service is subject to the following minimum conditions agreed at time of access:

  • The business customer accepts full responsibility for informing end users that their information will be processed by AI to generate eulogy content
  • The business customer accepts full responsibility for obtaining all necessary consents from end users under applicable law
  • The business customer agrees not to misrepresent the AI-generated nature of the output to end users
  • The business customer acknowledges that a formal Data Processing Agreement will be required before processing personal data of EU or UK residents

5. Ownership of generated content

5.1 — You own your eulogy

The eulogy generated through TreulogyAI belongs to you. You may use it freely for personal, family, and memorial purposes without restriction. You may deliver it, share it with family, print it, and preserve it as you wish.

5.2 — Our limited operating license

To deliver the Service, you grant Common Sense Goods Inc. a limited, non-exclusive, royalty-free, worldwide license to receive, store, and process the content you provide solely as necessary to generate your eulogy and operate the Service. This license extends to our service providers — including OpenAI — only to the extent required for generation and delivery. This license is revoked when your account is deleted and your data is removed in accordance with our Privacy Policy.

5.3 — Anonymized promotional use

We may occasionally use fully anonymized eulogy excerpts for promotional purposes — for example, to illustrate the quality and style of our output on our website or in marketing materials.

Before any excerpt is considered for promotional use, we remove or replace all identifying information, including:

  • Names of the deceased
  • Geographic locations
  • Relationship details
  • Any other information that could identify the individual or family

No excerpt will ever be used in a way that could reasonably identify your loved one or your family.

Opt-out: If you would prefer your content never be considered for promotional use, you may opt out at any time by contacting legal@treulogy.com with the subject line "Promotional opt-out." We will honor all opt-out requests promptly and permanently, and will record your preference on your account.

5.4 — No training use

We do not use your content to train AI models. Our AI provider (OpenAI) does not use API inputs and outputs to train its models by default. See our Privacy Policy for full details.


6. Your content and conduct

6.1 — Your representations

By using the Service you represent and warrant that:

  • You are at least 18 years of age
  • You are using the Service for its intended personal purpose
  • The information you provide is truthful to the best of your knowledge
  • You have the right to share the information you enter about the deceased and other individuals mentioned in your responses
  • Your use of the Service does not violate any applicable law

6.2 — Prohibited conduct

You may not use the Service to:

  • Generate content that is defamatory, harassing, hateful, or unlawful
  • Impersonate any person or entity
  • Attempt to circumvent or hack the Service
  • Generate eulogies for living individuals with intent to harm or harass
  • Use automated tools to access the Service beyond its intended use
  • Violate any applicable local, national, or international law or regulation

We reserve the right to suspend or terminate accounts that violate these prohibitions without notice or refund.

6.3 — Sensitive content

Our guided questions are designed to elicit positive memories and meaningful stories. You may encounter emotionally difficult content in the course of using the Service. If at any point you need support, we encourage you to reach out to a qualified mental health professional or grief support service.


7. AI consent and acknowledgment

7.1 — Pre-generation acknowledgment

Before your first eulogy is generated, you will be asked to acknowledge that:

  • Your responses will be processed by an AI writing tool
  • Your responses are not read by our team for content, marketing, or editorial purposes. Access to user data is limited to essential operational purposes only — such as responding to deletion requests, resolving technical issues, or complying with legal obligations — and is subject to strict confidentiality obligations.
  • The output is AI-generated and should be reviewed and personalized before delivery

This acknowledgment is required to use the generation feature. It is stored on your account with a timestamp.

7.2 — Nature of AI output

AI-generated content reflects patterns in language and the information you provide. It may not perfectly capture the voice, personality, or specific memories of your loved one. We make no warranty as to the quality, accuracy, emotional resonance, or suitability of any generated eulogy. You are solely responsible for reviewing and approving the content before use.


8. Refund policy

8.1 — Refund before first use

If you have purchased TreulogyAI but have not yet consented to AI processing and generated a eulogy — including if you decline to provide AI processing consent at the acknowledgment screen — you are entitled to a full refund. Contact us at legal@treulogy.com within 7 days of purchase and we will process your refund within 5 business days.

8.2 — Refund after first use

Once you have generated a eulogy, the Service has been delivered. We handle post-use refund requests on a case-by-case basis at our discretion. If you are unsatisfied with the output for any reason, contact us at legal@treulogy.com and describe your concern. We will work with you to find a fair resolution.

We are under no obligation to issue refunds where:

  • A eulogy has been successfully generated and delivered
  • The dissatisfaction relates to the nature of AI-generated content generally rather than a specific service failure
  • The request is made more than 30 days after purchase

8.3 — Service failures

If a technical failure prevents you from generating a eulogy — for example, due to an outage or error — and the issue cannot be resolved within a reasonable time, you are entitled to a full refund regardless of the above. Contact us at legal@treulogy.com.


9. Intellectual property

9.1 — Our property

All content on the TreulogyAI website, the application design, user interface, guided question framework, branding, and all other materials — excluding your generated eulogies — are owned by or licensed to Common Sense Goods Inc. and are protected by copyright and other intellectual property laws.

9.2 — Restrictions

You may not copy, reproduce, reverse engineer, or attempt to extract the source code, question framework, or any other proprietary element of the Service.

9.3 — Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use that feedback without restriction or compensation to you.


10. Privacy

Your use of the Service is subject to our Privacy Policy at treulogy.com/privacy-policy, which is incorporated into these Terms by reference. By accepting these Terms you also acknowledge that you have read and understood our Privacy Policy.

Key privacy commitments:

  • We collect only the minimum information necessary to generate your eulogy
  • Your responses are not read by our team for content, marketing, or editorial purposes — access is limited to essential operational purposes only
  • Your content is not used to train AI models
  • You may request deletion of your data at any time

 


11. Disclaimers and limitation of liability

11.1 — No warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

  • The Service will be available at all times or free from errors
  • The generated eulogy will meet your expectations or be suitable for your specific needs
  • The Service will be free from bugs, interruptions, or data loss

11.2 — Emotional sensitivity disclaimer

We recognize that our users are often in a period of grief and emotional vulnerability. While we have designed the Service with care and compassion, we cannot guarantee the emotional impact of AI-generated content about a deceased loved one. We encourage all users to review generated content carefully and reach out to grief support resources if needed.

11.3 — Limitation of liability

To the maximum extent permitted by applicable law, Common Sense Goods Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:

  • Dissatisfaction with AI-generated eulogy content
  • Emotional distress arising from use of the Service
  • Loss of data
  • Service unavailability
  • Actions taken based on generated content

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid for your purchase.

11.4 — Indemnification

You agree to indemnify and hold harmless Common Sense Goods Inc. from any claims, losses, damages, or expenses (including reasonable legal fees) arising from your violation of these Terms, your misuse of the Service, or your use of generated content.


12. Account termination

12.1 — Termination by you

You may close your account at any time by contacting legal@treulogy.com. Upon closure, your account data and eulogy content will be deleted within 30 days, subject to our legal retention obligations for purchase records.

12.2 — Termination by us

We reserve the right to suspend or terminate your account at any time if:

  • You violate these Terms
  • We suspect fraudulent or abusive use
  • We are required to do so by law

In the event of termination due to our decision rather than your violation, we will provide a pro-rated refund where applicable.

12.3 — Effect of termination

Upon account termination, your license to use the Service ends immediately. Sections 5, 9, 10, 11, and 13 of these Terms survive termination.


13. Governing law and dispute resolution

13.1 — Governing law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles.

13.2 — Jurisdiction

For users located in the United States, you agree that any dispute arising from these Terms shall be resolved in the courts of Alberta, Canada, and you consent to personal jurisdiction in that forum. Nothing in this section limits your rights under applicable consumer protection laws in your jurisdiction.

13.3 — Informal resolution first

Before initiating any formal legal proceeding, you agree to contact us at legal@treulogy.com and give us at least 30 days to resolve the dispute informally. We will make a genuine effort to do the same.


14. Changes to these terms

We may update these Terms from time to time. When we make material changes we will:

  • Update the "Last updated" date at the top of this page
  • Post a notice on the website for a reasonable period
  • Notify you by email if the changes materially affect your rights
  • Where changes affect AI processing acknowledgment, existing users will be shown an updated acknowledgment on their next login

Continued use of the Service after the effective date of revised Terms constitutes acceptance of the changes.


15. Severability and entire agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Common Sense Goods Inc. with respect to your use of the Service.
