1. WHO WE ARE AND WHAT THESE TERMS COVER

These Terms of Service ("Terms") govern your access to and use of TreulogyAI (treulogy.com), including the website, the application, and all services offered through them ("the Service").

TreulogyAI is a brand of Common Sense Goods Inc., a corporation incorporated in Alberta, Canada ("we," "us," or "our").

By purchasing access to or using the Service, you agree to these Terms. If you do not agree, do not purchase or use the Service.

2. WHAT TREULOGYAI IS
─────────────────────

TreulogyAI is an AI-assisted tribute creation application. It guides you through a series of questions about a loved one and uses your responses to generate personalized memorial content using artificial intelligence.

2.1 — What the Service produces:

The Service generates the following types of memorial content from a single set of memories and responses ("a Tribute"):

- Eulogies — spoken tributes for delivery at a funeral, memorial service, or gathering
- Obituaries — written notices for publication in print or online
- Funeral programs — content for printed or digital service programs
- Social posts — memorial content for sharing on social media platforms

All of these outputs are generated from the same Tribute — you share your memories once, and the Service creates whatever content you need from those memories.

2.2 — Living Tributes:

In addition to Memorial Tributes for those who have passed, TreulogyAI offers Living Tributes — a way to collect and celebrate the memories and stories of someone who is still alive. Living Tributes are designed to help families preserve meaningful stories before they are lost.

By creating a Living Tribute, you confirm that the person being celebrated is aware of and has consented to having their memories and stories collected in TreulogyAI.

2.3 — What the Service is not:

- A professional writing service — no human writer reviews, edits, or approves your content
- A grief counselling, therapy, or mental health service
- A guarantee of any particular quality, outcome, or reception of the generated content
- A substitute for your own review, personalization, and judgment before using any generated output

2.4 — AI-generated content disclosure:

You acknowledge that all content generated by TreulogyAI is produced by artificial intelligence. Your responses are processed by our AI writing tool to generate your tribute content. Access to your responses by our team is limited to essential operational purposes only — such as responding to deletion requests, resolving technical issues, or complying with legal obligations — and is subject to strict confidentiality obligations. No member of our team reads your responses for content, marketing, or editorial purposes.

By using the Service you confirm that you understand and accept this. You will be asked to acknowledge this specifically before your first tribute content is generated.

We strongly encourage you to read all generated content carefully, personalize it with your own voice, and make it your own before using or delivering it. AI-generated output is a meaningful starting point, not a finished product.

3. ACCOUNT CREATION AND ACCESS
──────────────────────────────

3.1 — How access works:

Access to TreulogyAI is provided following purchase on treulogy.com. Upon completing your purchase, a secure, time-limited, single-use login link will be sent to the email address you provided at checkout. This link provides access to your TreulogyAI account.

3.2 — Your account:

You are responsible for:
- Providing an accurate email address at checkout
- Keeping your login link and account access secure
- All activity that occurs through your account
- Notifying us immediately at legal @ treulogy . com if you believe your account has been compromised

You may not share, sell, or transfer your account or login access to any other person.

3.3 — Keeping your tributes together:

Your account is anchored to your email address. If you receive access to a tribute created on your behalf by a funeral home or other party, use the same email address when purchasing additional tributes to keep all your tributes in one place.

3.4 — One account per purchase:

Each purchase entitles one individual to access the Service. Accounts are personal and non-transferable. If you are a funeral home or other professional user purchasing access on behalf of multiple families, contact us at legal @ treulogy . com to discuss our B2B licensing options.

4. WHAT YOUR PURCHASE ENTITLES YOU TO
─────────────────────────────────────

4.1 — Tribute generation (fair use):

A single purchase of TreulogyAI entitles you to:
- Creation of Tribute memory collections for your personal use
- Generation of up to 100 individual pieces of content (eulogies, obituaries, programs, and social posts combined) from your Tributes
- Access to the full guided question experience for each Tribute
- The ability to create Tributes for multiple individuals using your single account

We set this limit generously — it is far beyond what any individual would need for personal use. It exists solely to protect the Service from abuse and to ensure a quality experience for all users. If you have a legitimate need that approaches this limit, contact us at legal @ treulogy . com and we will work with you.

We also reserve the right to apply reasonable rate limits on generation frequency to maintain service quality and prevent abuse. Current limits are 10 generations per output type per 24-hour period. Rate limits may be adjusted with 30 days notice.

4.2 — Personal use only:

Your purchase entitles you to use the Service for personal, non-commercial purposes only. This means you may use TreulogyAI to create tribute content for people in your own life — family members, friends, and loved ones.

You may not use TreulogyAI to:
- Create tribute content commercially on behalf of others for payment
- Resell, sublicense, or provide access to the Service to third parties
- Use the Service as part of a business offering without a separate B2B license agreement

Funeral homes, celebrants, and other professional users must contact us at legal @ treulogy . com for B2B licensing terms before using the Service commercially. Use of a consumer account for commercial purposes constitutes a material breach of these Terms.

4.3 — Service availability:

We make reasonable efforts to keep the Service available at all times. However we do not guarantee uninterrupted availability. The Service depends on third-party infrastructure including Bubble.io and OpenAI, and may be subject to outages, maintenance, or interruptions outside our control. We are not liable for any loss or inconvenience caused by service unavailability.

5. THE INFORMATION YOU SHARE
────────────────────────────

5.1 — What you provide:

In the course of using the Service you will be invited to share memories, stories, and details about the person your Tribute is for. This may include:

- Their preferred name, pronouns, and relationship to you
- Personality descriptions, interests, and life stories
- Family relationships and the names of family members and friends
- Career history, achievements, and life milestones
- Birthplace and approximate birth date
- Date, location, and circumstances of passing (for Memorial Tributes)
- Cause of death (optional — see below)
- A photo (optional)

All questions except those explicitly marked as required are optional. You are encouraged to share only what you are comfortable sharing and to use placeholders for sensitive details (such as "Hometown" instead of a specific city, or "Birthdate" instead of an exact date) if you prefer to keep certain information private.

5.2 — Cause of death:

The cause of death field is entirely optional. Where provided, this information is used only to inform the tone and language of the generated content. It is never included in any anonymized sample content, marketing materials, or promotional use — regardless of any other content preferences you have set. This field is handled with the highest level of sensitivity and confidentiality.

5.3 — Third-party names:

The guided questions invite you to share the names of family members, friends, mentors, and others connected to your loved one. By sharing third-party names and information you represent that you have an appropriate basis to include that information in a private memorial tribute. We use this information only to generate your tribute content and handle it in accordance with our Privacy Policy.

5.4 — Photo uploads:

You may optionally upload a photo to personalize your Tribute experience. The photo is displayed only within your Tribute to provide inspiration and context as you contribute memories. It is not shared with third parties, not used for any purpose beyond your Tribute display, and not included in the payload sent to our AI writing tool for content generation.

By uploading a photo you confirm that you have the right to use and store that image. Photos of living individuals should only be uploaded with that person's knowledge and consent.

5.5 — Your responsibility for content:

By using the Service you represent and warrant that:
- You are at least 18 years of age
- The information you provide is truthful to the best of your knowledge
- You have an appropriate basis to share the information you enter about third parties
- For Living Tributes, the subject of the Tribute has consented to having their memories collected
- Your use of the Service does not violate any applicable law

6. OWNERSHIP OF GENERATED CONTENT
─────────────────────────────────

6.1 — You own your tribute content:

The memorial content generated through TreulogyAI belongs to you. You may use it freely for personal, family, and memorial purposes without restriction — including delivering it, sharing it with family, printing it, publishing it, and preserving it.

6.2 — Our limited operating license:

To deliver the Service, you grant Common Sense Goods Inc. a limited, non-exclusive, royalty-free, worldwide license to receive, store, and process the content you provide solely as necessary to generate your tribute content and operate the Service. This license extends to our service providers — including OpenAI — only to the extent required for generation and delivery. This license is revoked when your account is deleted and your data is removed in accordance with our Privacy Policy.

6.3 — Anonymized promotional use:

We may occasionally use fully anonymized tribute excerpts for promotional purposes — for example, to illustrate the quality and style of our output on our website or in marketing materials.

Before any excerpt is considered for promotional use, we remove or replace all identifying information, including:
- Names of the deceased or living subjects
- Geographic locations
- Relationship details
- Cause of death information
- Any other information that could identify the individual or family

No excerpt will ever be used in a way that could reasonably identify your loved one or your family.

Opt-out: If you would prefer your content never be considered for promotional use, you may opt out at any time by contacting legal @ treulogy . com with the subject line "Promotional opt-out." We will honour all opt-out requests promptly and permanently, and will record your preference on your account.

6.4 — No AI training use:

We do not use your content to train AI models. Our AI provider (OpenAI) does not use API inputs and outputs to train its models by default. See our Privacy Policy for full details.

7. TRIBUTE STORAGE
──────────────────

7.1 — Standard storage period:

Tributes are stored for 12 months from the date of creation. At the 11-month mark, you will receive an email notification advising that your Tribute is approaching its deletion date and offering you the option to extend storage.

7.2 — Storage extension options:

You may extend your Tribute storage by selecting one of the following options when notified:

- Free annual renewal — extend storage for a further 12 months at no charge, with your consent
- Paid lifetime archive — preserve your Tribute permanently for a one-time fee of $19.99 USD

Storage extensions require fresh consent and will not be assumed or applied automatically.

7.3 — Deletion:

If no extension is selected by the deletion date, your Tribute and all associated content will be permanently and securely deleted. Deletion is irreversible. We recommend downloading or saving any generated content you wish to keep before the deletion date.

7.4 — Tributes received from funeral homes:

If your Tribute was created through a funeral home's TreulogyAI subscription, you are the Tribute owner and retain permanent access to your Tribute regardless of the funeral home's subscription status. The same storage lifecycle and extension options apply.

8. AI CONSENT AND ACKNOWLEDGMENT
────────────────────────────────

8.1 — Pre-generation acknowledgment:

Before your first piece of tribute content is generated, you will be asked to acknowledge that:
- Your responses will be processed by an AI writing tool
- Your responses are not read by our team for content or marketing purposes
- The output is AI-generated and should be reviewed and personalized before use

This acknowledgment is required to use the generation feature. It is stored on your account with a timestamp and version record.

8.2 — Nature of AI output:

AI-generated content reflects patterns in language and the information you provide. It may not perfectly capture the voice, personality, or specific memories of your loved one. We make no warranty as to the quality, accuracy, emotional resonance, or suitability of any generated content. You are solely responsible for reviewing and approving the content before use.

9. REFUND POLICY
────────────────

9.1 — Refund before first use:

If you have purchased TreulogyAI but have not yet generated any tribute content — including if you decline to provide AI processing consent at the acknowledgment screen — you are entitled to a full refund. Contact us at legal @ treulogy . com within 7 days of purchase and we will process your refund within 5 business days, no questions asked.

9.2 — Refund after first use:

Once tribute content has been generated, the Service has been delivered. We handle post-use refund requests on a case-by-case basis. If you are unsatisfied for any reason, contact us at legal @ treulogy . com and describe your concern. We will work with you to find a fair resolution.

9.3 — Service failures:

If a technical failure prevents you from generating content and the issue cannot be resolved within a reasonable time, you are entitled to a full refund. Contact us at legal @ treulogy . com.

10. INTELLECTUAL PROPERTY
─────────────────────────

10.1 — Our property:

All content on the TreulogyAI website, the application design, user interface, guided question framework, branding, and all other materials — excluding your generated tribute content — are owned by or licensed to Common Sense Goods Inc. and are protected by copyright and other intellectual property laws.

10.2 — Restrictions:

You may not copy, reproduce, reverse engineer, or attempt to extract the source code, question framework, or any other proprietary element of the Service.

10.3 — Feedback:

If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use that feedback without restriction or compensation to you.

11. PRIVACY

Your use of the Service is subject to our Privacy Policy at treulogy.com/privacy-policy, which is incorporated into these Terms by reference. By accepting these Terms you also acknowledge that you have read and understood our Privacy Policy.

12. PROHIBITED CONDUCT

You may not use the Service to:
- Generate content that is defamatory, harassing, hateful, or unlawful
- Impersonate any person or entity
- Attempt to circumvent, hack, or exploit the Service
- Use automated tools to access the Service beyond its intended use
- Generate content for living individuals without their knowledge or consent
- Violate any applicable local, national, or international law

We reserve the right to suspend or terminate accounts that violate these prohibitions without notice or refund.

13. DISCLAIMERS AND LIMITATION OF LIABILITY
───────────────────────────────────────────

13.1 — No warranties:

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be available at all times, free from errors, or that generated content will meet your expectations.

13.2 — Emotional sensitivity:

We recognize that our users are often navigating grief and loss. While we have designed the Service with care and compassion, we cannot guarantee the emotional impact of AI-generated content. We encourage all users to review generated content carefully and to reach out to grief support resources if needed.

13.3 — Limitation of liability:

To the maximum extent permitted by applicable law, Common Sense Goods Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you shall not exceed the amount you paid for your purchase.

13.4 — Indemnification:

You agree to indemnify and hold harmless Common Sense Goods Inc. from any claims, losses, or expenses arising from your violation of these Terms or your misuse of the Service.

14. ACCOUNT TERMINATION
───────────────────────

14.1 — Termination by you:

You may close your account at any time by contacting legal @ treulogy . com. Upon closure, your account data and tribute content will be deleted within 30 days, subject to legal retention obligations for purchase records.

14.2 — Termination by us:

We reserve the right to suspend or terminate your account if you violate these Terms, we suspect fraudulent or abusive use, or we are required to do so by law. In the event of termination due to our decision rather than your violation, we will provide a pro-rated refund where applicable.

14.3 — Survival:

Sections 6, 10, 11, and 13 of these Terms survive termination.

15. GOVERNING LAW AND DISPUTE RESOLUTION
────────────────────────────────────────

15.1 — Governing law:

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein.

15.2 — Jurisdiction:

For users located in the United States, any dispute arising from these Terms shall be resolved in the courts of Alberta, Canada. Nothing in this section limits your rights under applicable consumer protection laws in your jurisdiction.

15.3 — Informal resolution first:

Before initiating any formal legal proceeding, you agree to contact us at legal @ treulogy . com and give us at least 30 days to resolve the dispute informally.

16. CHANGES TO THESE TERMS
──────────────────────────

We may update these Terms from time to time. When we make material changes we will update the "Last updated" date, post a notice on the website, and notify you by email if the changes materially affect your rights. Continued use of the Service after the effective date constitutes acceptance of the changes.
